According to the Ontario government information page, the declaration of emergency has been made under the Emergency Management and Civil Protection Act, R.S.O. 1990, c. E.9.
That page links, incorrectly, to s. 4 (https://www.ontario.ca/laws/statute/90e09#BK5) which is about a municipality declaring an emergency.
It is s. 7.0.1 (https://www.ontario.ca/laws/statute/90e09#BK12) which allows a premier to declare an emergency for the province.
